Guide to Real Estate in and around Puerto Banus Marbella

British citizens traveling to Spain with the intention of purchasing property are strongly advised to engage a local lawyer. Some general guidance notes on the subject are available from the Spanish Desk in the Consular Division of the Foreign and Commonwealth Office, Room G/105/6, Old Admiralty Building, Whitehall, London, SW1A 2PA; and from British Consular Offices in Spain.
Timeshare Ownership is well established in Spain with many known and respected companies, agents and resorts operating legally, fairly and successfully. However, there are equally many unscrupulous companies who claim to provide various special offers (including stock market investments and discounts on airfares and accommodation) when exchanging existing timeshare, ownership or taking out membership of holiday clubs beware, more often than not, such inducements do not materialize once a deal has been signed and sealed. Anyone who is approached by agents operating such schemes should treat the approaches with the utmost caution.
When deciding on purchasing a property in Spain, good advice is to seek legal advice in connection with the purchase and the transfer of the property. A lawyer will check whether the property is free of liens, encumbrances and tenants, and will assist in revising the conditions of the purchase contract or make a draft in case such does not exist.
The fees
Related to a property purchase the fees in general are:
a) legal fees
b) Notary fees
c) Property Registry fee
It is common that the lawyer charges 1% of the purchase value, plus 16% VAT, for assisting in a property purchase. The transfer of the property is done before the Notary upon signing the Title Deeds of the property (Sp. Escritura Pública), and which fee is fixed by law and related to the purchase value. Generally, it does not exceed 600 Euro for a reasonably priced property. Finally, the property must be registered in the corresponding Municipal Property Registry, and this amounts to in general to approximately 40% of the Notary fees.
When Purchasing A Second Hand Property
A Transfer Tax (ITP) of 6% is applied to the official purchase sum. If you are purchasing a new property or a property in the course of construction, 7% VAT (IVA) plus 0,5% Stamp Duty of the official purchase sum is applied. In case of a purchase of parcels of land, commercial premises or garage, the IVA rate is 16%, plus 0,5% Stamp Duty.
